Terms of Service

These Terms of Service govern your use of the Traqr app and the traqr.health website (together, “the app”). By downloading, installing or using Traqr, you agree to these terms. If you do not agree, please do not use the app.

1. Medical disclaimer

• The app is a personal tracking tool only. It does not diagnose, treat, cure or prevent any disease or medical condition.
• Weight forecasts, pharmacokinetic estimates and nutritional analyses are approximations for informational purposes only and must not be used to make medical decisions.
• AI-powered food analysis provides estimates, not precise measurements. Actual values may vary.
• Always consult your prescribing doctor or a qualified healthcare professional before making changes to your medication, diet or exercise.
• Never disregard professional medical advice, or delay seeking it, because of something you have read or seen in the app.
• Using Traqr does not create a clinician–patient relationship between you and us.

3. Eligibility

You must be at least 16 years of age to use Traqr. By using the app, you confirm that you meet this requirement.

4. Your account and data

• You are responsible for maintaining the security of your device and account.
• You are responsible for all activity that occurs under your account.
• You may delete your account and all associated data at any time from the Settings screen.

5. Subscriptions and purchases

5.1 A subscription is required

Traqr is a paid app. Using Traqr requires an active subscription, which starts with a free trial. There is no permanently free version of the app — once your free trial ends, a paid subscription is needed to keep using it.

5.2 Free trial

• New accounts start with a 14-day free trial that gives you full access to the app.
• You can cancel at any time during the trial and you will not be charged.
• If you do not cancel before the trial ends, your subscription begins automatically and your chosen plan is charged.

5.3 Plans and billing

• After the trial you can continue on an auto-renewing monthly or annual subscription, or make a one-time lifetime purchase.
• Subscriptions and purchases are billed through the Apple App Store or Google Play Store.
• Payment is charged to your App Store or Play Store account, at the price shown, when you confirm the purchase.
• Auto-renewing subscriptions renew automatically unless cancelled at least 24 hours before the end of the current billing period.

5.4 Cancellation and refunds

• You can cancel at any time through your device’s App Store or Play Store settings.
• If you cancel an auto-renewing subscription, cancellation takes effect at the end of the current billing period and you keep access until then.
• Refund requests must be directed to Apple or Google in line with their refund policies.

6. Acceptable use

You agree not to:

• use the app for any unlawful purpose;
• attempt to gain unauthorised access to our systems or other users’ data;
• reverse-engineer, decompile or disassemble the app;
• use automated systems to access the app in a way that exceeds reasonable use; or
• abuse the AI analysis feature (rate limits apply).

7. Data accuracy

• Data you enter is stored as provided. We do not verify the accuracy of user-entered health data.
• AI-generated nutritional estimates are approximations and may be inaccurate; do not rely on them as your sole source of nutritional information.
• Weight forecasts are statistical estimates and are not guaranteed outcomes.
• Pharmacokinetic estimates are based on published population models and may not reflect your individual metabolism.

8. Intellectual property

The app — including its design, code and content — is owned by us and protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable licence to use the app for personal, non-commercial purposes.

9. Limitation of liability

To the maximum extent permitted by law:

• the app is provided “as is” and “as available”, without warranties of any kind, whether express or implied;
• we do not warrant that the app will be uninterrupted, error-free or free of harmful components;
• we are not liable for any indirect, incidental, special, consequential or punitive damages arising from your use of the app; and
• our total liability for any claim relating to the app will not exceed the amount you paid for the app or subscription in the 12 months before the claim.

Nothing in these terms limits or excludes any rights or guarantees you have under the New Zealand Consumer Guarantees Act 1993 or the Fair Trading Act 1986 that cannot be lawfully excluded.

10. Indemnification

You agree to indemnify and hold us harmless from any claims, damages or expenses arising from your use of the app or your breach of these terms.

11. Termination

We may suspend or terminate your access to the app at any time, with or without cause. On termination, your right to use the app ceases immediately. You may request deletion of your data as described in our Privacy Policy.

12. Changes to these terms

We may update these terms from time to time. Any changes will be reflected by the “Last updated” date above. Continued use of the app after changes take effect constitutes acceptance of the updated terms.

13. Governing law

These terms are governed by and construed in accordance with the laws of New Zealand, without regard to conflict of law principles. You submit to the non-exclusive jurisdiction of the New Zealand courts.
