Care Team Recipient Terms

1. What these terms are
These terms govern your use of the Traqr Care Team portal (clinic.traqr.health) as a recipient — a person someone has chosen to share their Traqr health data with. They are an agreement between you and Traqr Limited, a New Zealand company (“Traqr”, “we”). The Traqr Terms of Service also apply to your use of the portal; where they conflict, these Care Team terms prevail.
2. Accepting these terms, and changes
You accept these terms by selecting “Agree & continue” in the portal. If we update them, you will be asked to accept the new version before you can continue to access any shared data. Each acceptance is recorded (version and time).
3. Who can use the portal
You must be at least 18, provide accurate profile information, keep your sign-in credentials to yourself, and maintain multi-factor authentication. Your account is personal — it may not be shared, transferred, or operated on someone else’s behalf.
4. What you get
A personal, non-transferable, revocable right to view — through the portal only — the data categories each person has chosen to share with you, until they revoke or their share expires. Access is currently free. We may change or discontinue the portal.
5. How you may use shared data
People share their health data with you to be supported — nothing else. You agree to:
- use shared data only to support the person who shared it;
- never use it for marketing, advertising, resale, profiling, or building or training models or AI, and never share it onward or pass it to anyone else;
- not use the portal as a clinic’s, health plan’s, or other organisation’s own patient-management or record-keeping system — professional use is welcome when a person chooses to share with you, but no organisation may direct, require, or contract for your use of it.
6. Confidentiality — and it continues
You will keep shared data confidential. These obligations — confidentiality and the use restrictions in section 5 — continue to apply after a person revokes their share, a share expires, or your account is suspended, removed, or deleted, and they apply to any copies or exports you have kept (including downloaded reports), for as long as you hold them.
7. Deleting what you hold
If the person who shared data with you asks you to delete copies you hold, you will do so promptly. If we end your access for breach, we may also require you to delete retained copies.
8. About the data itself
Shared data is self-reported wellness information, provided as-is. Traqr does not verify its accuracy or completeness, does not verify the identity of the person sharing it, and it is not a medical record. If you use it in a professional capacity, you rely on your own professional judgement. To the extent permitted by law, we make no warranty about shared data.
9. Our relationship
Traqr provides this service to the individual who shares, not to you or any organisation. These terms create no business-associate relationship under US HIPAA, and Traqr does not sign business associate agreements for this consumer service. If your organisation wants Traqr in a clinical workflow, contact support@traqr.health.
10. Your information
Your account details, profile, terms acceptances, and access logs are handled as described in the Traqr Privacy Policy(see “Sharing your data with a Care Team”).
11. Suspension and ending
We may suspend or remove your account at any time if we reasonably believe you have breached these terms or pose a risk to a person sharing data. When your access ends — for any reason — your right to view shared data stops, and section 6 continues to apply. Sections 5–9, 12 and 13 survive.
12. Liability and indemnity
The limitation of liability and indemnification provisions of the Traqr Terms of Service apply to your use of the portal, to the maximum extent permitted by law. Nothing in these terms limits rights you have under consumer laws that cannot be excluded.
13. Governing law
These terms are governed by the laws of New Zealand, and the New Zealand courts have non-exclusive jurisdiction — without limiting any mandatory consumer protections where you live.
14. General
These terms plus the Traqr Terms of Service and Privacy Policy are the whole agreement for your portal use. If part of these terms is unenforceable, the rest still stands. We may assign this agreement as part of a business transfer; you may not assign it. Not enforcing a term is not a waiver.
